PROVISION OF SERVICE
CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 1999
All prices displayed are retail prices in GBP Pounds Sterling, and include 20% VAT and Standard Delivery to mainland UK at the prevailing rate for the goods or services being supplied.
Unless stated otherwise, the price detailed on the relevant Product Page refers to purchasing one item of the specified size, regardless of the number or size of items displayed in the images for that product. There are no hidden extra costs. Prices are subject to change without prior notice.
Ordering from us is very safe and straightforward. You can order
♦ by phone
♦ by email
If you would like to make a purchase, please specify the size, colour and quantity on the relevant Product Page and submit your choice to the Order Page by clicking on the 'ADD TO ORDER' button. When you have completed your choice of product(s), your order value will be displayed. If required, you can specify your choice of non-standard delivery service and you are given the opportunity to supply us with any special instructions or information with regards to your order which, if in any way possible, we will be happy to take into consideration. You are then invited to make your payment. Alternatively, you can send us your order details by email and pay over the phone or by bank transfer (see PAYMENT). As soon as we have received your order and payment, we will confirm within 24 hours whether your order has been successful. This confirmation will include your unique Order Number and the invoice/delivery details received by us. We will advise you about the estimated delivery date of your order shortly afterwards.
We will of course be very happy to answer any queries you may have at any time and, wherever possible, we will aim to accommodate special requirements. If you would like to order non-standard dimensions or if you have any other bespoke request, please don't hesitate to contact us as we will be very pleased to be of help.
We cannot accept orders from any person younger than 18 years of age without the consent of that person's parent or carer.
We can accept any of the following methods of payment:
♦ by telephone
♦ by bank transfer
♦ by cheque
♦ Online Payment
Trust is an absolute key factor in our relationship with you, our customer.
HSBC's Global Iris Payments provides a highly secure, integrated shopping environment and ensures our payment system is always completely up-to-date. Global Iris Payments incorporate Verfied by Visa and Mastercard®SecureCode™ solutions, which enable authentication whilst on-line. The checkout process is performed on HSBC's Global Iris Server, which will encrypt (128-bit) all your input, making it impossible for any data transmitted from your computer to be intercepted by others.
HSBC will take your credit/debit card details and validate them. Please make sure that the billing address you enter matches the exact address details your card issuer holds (as showing on your card statements), otherwise your payment will not be authorised. You will then be returned back to our website and be issued with a transaction confirmation.
Your credit card details are known only to HSBC - the only information we keep is whether your transaction was successful or not. How it works:
- You find a product, add it to your order and click to go to the checkout.
- Your order is encrypted and is passed to the HSBC Global Iris Server for payment.
- You provide your card and address details (card details revealed only to HSBC's Global Iris Server).
- Your details are security-checked and verified with the relevant card issuer.
- You receive a message in your internet browser window to tell you that your transaction has completed successfully.
- Within4Walls can now check and process your order.
For any Custom Order products, on-line payments take a 50% deposit at time of order, with the remaining 50% balance to be paid prior to delivery.
For all other products, full payment will be taken at time of order.
If you would like to pay over the phone, please call us with the details of the products you would like to order, as well as your billing address (as showing on your card statements) and delivery address and telephone number. We will then take your card details. Confirmation of your order will be sent to you after your successful payment has been received. For Custom Orders we take a 50% deposit, with the remaining 50% balance to be paid before delivery of your order. For this we will contact you to re-confirm your card details. For all other products, full payment will be taken at time of order.
♦ Personal or Bank Cheques
Should you prefer to pay by cheque instead, please send us or call us with the details of the products you would like to order, as well as your billing address (as showing on your card statements) and delivery address and telephone number together with a cheque for the amount due. Please make your cheque payable to Within4Walls Ltd.
We require 5 working days for bank clearance prior to placing the order with our supplier(s), therefore full confirmation of your successful order will be sent to you as soon as your payment has cleared. For Custom Orders, cheque payments should cover a 50% deposit payment at time of order, with the remaining 50% balance to be paid prior to delivery. For all other products, full payment will be taken at time of order.
♦ Bank Transfer
If you would like to make a bank transfer, please send us an email or call us with the exact information about the products you would like to order, as well as your correct billing and delivery address and telephone number. We will then send you an Order Summary and supply you with our banking details. Confirmation of your order will be sent to you as soon as your successful payment has been received.
We always require cleared payment in order to start processing your order and any outstanding balances must be paid prior to delivery. If for any reason an invoice becomes overdue for payment, the full outstanding account is immediately due and payable. We reserve the right to charge interest on overdue amounts at 3% above HSBC's base lending rate for the time being in force calculated on a daily basis. Payment shall be deemed to have been received only when the full amount of the value of the goods as invoiced (plus interest) has been credited to our bank account without recourse or we have received the full amount in cash.
We do not offer trade accounts - all orders are accepted on a pro forma basis only.
PACKAGING and DELIVERY
We deliver worldwide.
No matter how fragile the product, we would like to assure you that every care will be taken to pack each order meticulously, using strong protective outer packaging and as much soft, shock-absorbing material as needed to protect against transit damage. Export orders are always securely wrapped, packed and crated for optimum protection.
Standard Mainland UK Delivery costs are included in our prices. This type of delivery will arrive at your specified delivery address realistically anytime between 7.30 - 18.30 during the day the delivery is arranged for and includes England, Wales, and Southern and Central Scotland. For delivery outside these areas the following surcharges will apply:
Scottish Highlands and Scilly Isles add £ 45.00
Isle of Wight add £ 45.00
Scottish Islands add £ 70.00
Isle of Man add £ 45.00
Northern Ireland add £ 50.00
If your delivery address is outside the UK, please contact us for a shipping quote.
Delivery times count from the moment your payment has cleared and you have received our Order Confirmation; they vary according to the product and are entirely dependent upon manufacturing lead times. We will of course make every effort to keep to the delivery times as mentioned for each product, but due to the fact that many products are (hand)made to order, we hope you understand that we cannot guarantee a set delivery time as it may sometimes take longer than the estimated time for your order to be completed. However, it is also very possible for your order to be ready earlier than estimated.
Any time or date given by us must be treated as an estimate only, and no liability can be accepted by Within4Walls for failure to deliver within these estimated delivery times. If we cannot deliver your order within the estimated time, we will notify you and try to agree on another time for delivery. We shall not be liable for any loss or damage whatsoever arising directly or indirectly from any delay in the delivery of your order. Once your order is ready to be delivered, we will contact you by email and arrange a date and time for delivery. Should your order consist of multiple items, each item will be delivered as and when ready. Delivery will be arranged either directly by our suppliers, be undertaken by Within4Walls staff or will be arranged for by our approved carrier. In order to assure a smooth delivery process, we will need to disclose your contact telephone number to those in charge of delivery in case they need to contact you.
You must sign for delivery of the goods on arrival and confirm that the contents are complete and in good order.
Please sign 'unchecked' if you are not able to check the goods before signing.
It is also the responsibility of the person placing the order to ensure that the goods are of the correct dimensions both for access to the delivery address and the space for which the goods are intended. Where access to the delivery address is limited, or additional equipment is required to complete delivery of the goods, additional charges to cover the full costs of these services plus administrative costs will apply. A re-delivery charge will be made if a second delivery is necessary because:
- you are not at home to receive your order at the pre-arranged delivery time,
- your goods must be redelivered because they cannot fit into the premises without additional work or equipment,
- your goods must be redelivered for any other reason.
You will love our products, we are very sure!
But, in the very unlikely event that you are not completely satisfied with your order, you must notify us strictly within 3 working days of delivery, detailing the reason for your dissatisfaction. No goods are to be returned to us without prior notification and without our strict authorisation. Goods which are unused, undamaged, in their original packaging and fully marketable, may be returned strictly within 14 working days from delivery. The goods must be in their original packaging as received from us, neatly cared for and in immaculate condition. We unconditionally reserve the right not to refund if the goods are not returned in an 'as new' condition. More specifically, we cannot accept returned items which fall into the following categories:
- any personalised goods or goods made to your specification,
- any items which have been used in any way and are no longer suitable for resale,
- any items which have been stained, damaged in the wash or wrongly treated,
- any packages where the postage is unpaid.
Unless there is a manufacturing fault or they were damaged in transit (see Damaged Goods), authorised goods need to be returned to us at your own cost. Refunds are made for the cost of the goods excluding any Postage and Packing. Where you have made your own arrangement for the return, the goods must be fully insured during transit and must be adequately packed in the original packaging to prevent damage. Within4Walls cannot be held liable for any damages or losses in the return transit service. In general terms, the company who delivered your items to you should also be used for returns. Please make sure the offered compensation for loss or damage covers the value of the goods to be returned. If you are in any doubt, please contact us. Goods authorised to be returned should be sent to: Within4Walls Limited, Thrackum Hall, Station Road, Little Shrewley, Warwickshire CV35 7HH.
For goods returned to us any later than 14 working days from delivery, please note the following:
- For returned goods received by Within4Walls between calendar days 15 and 21 after initial delivery to you, you will incur a 10% administration charge.
- For returned goods received by Within4Walls between calendar days 21 and 28 after initial delivery to you, you will incur a 50% administration charge.
- Goods returned to Within4Walls after 28 days will not be refunded.
Many of our products are made-to-order goods of high value and the complexity of their production requires extended lead times. Orders for these goods are classed as CUSTOM ORDERS, notice of which is given on the Product Page of each product. At our discretion we will accept the return of Custom Order goods, but any shipping/delivery costs incurred by Within4Walls as well as a minimum stocking fee of 10% will be deducted from your refund.
EXPORT AND IMPORT ORDERS
Unless there is a manufacturing fault, or damage occurred in transit (see Damaged Goods), where an authorised refund concerns a Custom Order consisting of items of high value, which were imported into the UK or exported from the UK specifically for your order and on your request, we reserve the right to deduct any shipping and delivery costs incurred by Within4Walls from your refund.
Where an order involves goods to be exported outside the UK, we guarantee that these goods will leave the UK in perfect condition and full working order. However, once delivery has been made, we are not to be held liable for any damage due to incorrect or unsafe storing or handling of the goods. Installation and assembly of your order will be entirely your, our client's, responsibility and we will not be held liable for damage to any incorrectly handled or incorrectly fitted products.
For more complex, very large or bespoke products, we will be pleased to quote for a full installation service.
Our legal obligation to you, our customer, under the European Directive incorporated into UK Law by The Consumer Protection (Distance Selling) Regulations 2000, is to grant you the unconditional right to cancel your order from the date of the contract and up to the point where you have been contacted to arrange delivery and arrangements for delivery have been agreed. Should you make a cancellation beyond this point, we will deduct your refund with the amount of any delivery charges and cancellation penalties which Within4Walls may have incurred as a direct result of your order cancellation.
Many of our products are made-to-order goods of high value. Notice is given with the relevant product specifications that orders for these goods are classed as CUSTOM ORDERS and may only be cancelled strictly within 1 week of ordering, as work on the product by then will have started. Any cancellations beyond this point will lead to your refund being deducted by the amount of any cancellation penalties which Within4Walls has incurred as a direct result of the cancellation of your order. Cancellations should be made by telephone only. We will make a refund to you within 30 days of the cancellation.
Should the product you ordered be incomplete, show a manufacturing fault or have been damaged in transit, you need to notify us in writing strictly within 3 days of delivery. We can then either replace the defective product as soon as possible depending on the nature of the product/order, or offer you a full refund within 30 days. Where the defect or damage is readily visible, this should be highlighted at the time of delivery. We shall be under no liability whatsoever in respect of any defect caused by fair wear and tear, by negligence or wilful damage, by failure to follow our instructions or those given by the supplier, by alteration of the goods without our approval or by any other act of misconduct by third parties.
All goods sold by us are warranted free from defects in material and workmanship. In the very unlikely event that you should find goods to be defective in respect of materials or workmanship only, you need to notify us in writing within 3 days of delivery of the goods. We will investigate and examine the goods and to our discretion either replace the defective goods or refund the purchase price (see Damaged Goods) We will not be liable for any goods which have been repaired or altered in any way or have been the subject of any accident or damage caused by any innocent, willful or negligent act by you or through use of the goods not in accordance with the manufacturer’s instructions.
We strongly advise you to employ professional tradesmen (e.g. electricians, carpenters, plumbers) with regard to the installation of goods of the type which need to be installed properly and safely in accordance with manufacturer’s instructions and codes of practice. Any installation that has not been carried out by a qualified professional will render any warrantees null and void.
RISK and PROPERTY
No property or title to goods shall pass to you unless and until the full amount of the value of the goods as invoiced has been credited to our bank account without recourse or we have received the full amount in cash. Risk of damage to or loss of the goods shall pass to you at the time of delivery or attempted delivery or, if you wrongfully fail to receive the delivery as arranged, at the time when Within4Walls has tendered delivery of the goods.
We want you to be completely satisfied with the products you purchase from us and the service we offer. If there is anything not to your satisfaction please let us know immediately so that we can act accordingly and effectively. We aim to respond to all complaints within 2 working days.
We are by law obliged to inform you thatany disputes between European consumers and traders can now be settled out-of-court through an Alternative Dispute Resolution (ADR) or Online Dispute Resolution (ODR) procedure. This new legislation on ADR and ODR will allow consumers and traders to resolve their disputes without going to court in an easy, fast and inexpensive way.
The ODR platform is a web-based platform that is specifically designed to help consumers who have bought goods or services online and subsequently have a problem with that online purchase. It allows consumers to submit their contractual dispute and conduct the ADR procedure online and in any of the 23 official languages of the European Union. The ODR platform transmits disputes only to ADR bodies who are included in the national lists of ADR bodies that comply with the binding quality requirements established by the ADR Directive.
